This document governs the contractual relationship between the Company and the User. We operate in strict accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 of the United Kingdom.
2. Data Acquisition & Processing (GDPR Article 6)
We process personal data only when we have a lawful basis. This includes: (a) Fulfillment of Contract: processing your address and payment to deliver food; (b) Legal Obligation: maintaining tax records; (c) Legitimate Interests: improving our routing algorithms. We collect IP addresses, geolocation data, behavioral metrics, and PII (Personally Identifiable Information) including name, telephone number, and dietary preferences. All data is encrypted at rest using AES-256 standards.
3. International Data Transfers
While our primary servers are located within the UK, certain third-party processing (e.g., payment gateways) may involve the transfer of data outside the EEA. In such cases, we ensure that Standard Contractual Clauses (SCCs) are in place to guarantee a level of protection equivalent to UK law.
4. Limitation of Liability & Indemnity
To the maximum extent permitted by English law, PULPD LTD shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising from the delivery of services is strictly limited to the monetary value of the specific order in question. We do not exclude liability for death or personal injury caused by our negligence.
5. User Rights (The Right to be Forgotten)
Under GDPR, you have the right to access, rectify, or erase your data. Requests must be sent to our Data Protection Officer at info@kimberleycounsel.sbs. We will respond to all verified requests within 30 days. Please note that certain data must be retained for 7 years to satisfy UK HMRC tax regulations.
6. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England.
